Nytch, Inc. (“Nytch,” "Company," "we," or "us") operates certain online services and Company software applications, including but not limited to our www.nytch.me website (“Website”), programs and mobile applications (collectively with the Website, the “Services”).

This page informs you of our policies regarding collecting, using, and disclosing personal data when you use our Services and the choices you have associated with that data (“Privacy Policy”).  This Privacy Policy is a legally binding agreement between you ("User", "you" or "your") and the Company. By accessing and using the Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Privacy Policy. This Privacy Policy does not apply to the practices of companies that we do not own or control.  This Privacy Policy applies to all of our Services.

  • Service:  Service means our online and Company software applications, including but not limited to the Company’s online services and Company software applications, including but not limited to our www.nytch.me website.

  • Personal Data:  Personal Data means data about a living individual who can be identified from that data (or from other information either in our possession or likely to come into our possession).

  • Usage Data:  Usage Data is data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

  • Data Subject (or User):  Data Subject is any living individual who is using our Service and is the subject of Personal Data.

Information Collection and Use

We collect several different types of information for various purposes to provide and improve our Service to you.  Our information collection includes using cookies on a computer/handheld device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States. If you reside outside the United States, your information will be transferred, processed and stored there under United States privacy standards.

Information You Choose to Give Us

When you use our Services, we collect the information you choose to share with us, including certain personally identifiable information that can be used to set up your account and profile and contact or identify you (“Personal Data”). Personally identifiable information may include, but is not limited to:

  • Account Registration Information (i.e., user name, password)

  • Email address

  • Phone number

  • Physical address locations

  • Personal Items

  • Purchase history

  • First name and last name

You may also provide us with other data that is not Personal Data that you send through the Services  (i.e., the information you might provide when through customer support and on your profile). In addition, if you are providing information related to tax filings, all information on those filings will be provided to the government.

As part of our Services, we may provide opportunities for you to publicly post reviews, questions, comments, suggestions or other content, which may include Personal Data and portions of your user profile designated as public profile information, like your name or user name. Anything you share in a public forum is public, so think carefully about what you decide to share. We may use your Personal Data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

Usage Data

We may also collect information that your browser sends whenever you visit our Service or access the Service through a mobile device.  This Usage Data may include information such as your computer’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.  When you access the Service by or through a mobile device, this Usage Data may include information such as the type of mobile device you use, your mobile device's unique ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, unique device identifiers and other diagnostic data.

We may use and store information about your location if you give us permission to do so (“Location Data”). We use this data to provide our Service's features and improve and customize our Service.  You can enable or disable location services when you use our Service at any time through your device settings.

Camera & Photos

Certain of our Services require us to collect images, like your items, and other information from your device's camera and photos.

Some of our Services may rely on information about where you are located provided by you. We might also collect information from other users like you through things like a member referral program.

Tracking & Cookies Data

We use cookies and similar tracking technologies to track the activity on our Service and hold certain information.  Cookies are files with a small amount of data which may include an anonymous unique identifier. Cookies are sent to your browser from a website and stored on your device. Tracking technologies also used are beacons, tags, and scripts to collect and track information and to improve and analyze our Service. Use of Data

Please note that we never sell your information to any third party.

  • Providing features like posting Listings for our Users. When you register for a user account, we use the Personal Information you provide in order to create and maintain your user profile and connect you to purchase items to provide upfront price quotes. The information we collect as you use the Services also goes into developing and bringing you our various other features like account aggregations, encrypted communication channels, customer support, and personalized offer recommendations;

The Company may also use your collected data for various other purposes, including, but not limited to:

  • To provide and maintain our Service

  • To notify you about changes to our Service

  • To allow you to participate in interactive features of our Service when you choose to do so

  • To provide customer support

  • To gather analysis or valuable information so that we can improve our Service

Retention of Data

We will use commercially acceptable means to retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes (including establishing, exercising, or defending legal claims), and enforce our legal agreements and policies.  The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.

Business Transaction

If the Company is involved in a merger, acquisition or asset sale, your Personal Data may be transferred.

Under certain circumstances, the Company may be required to disclose its Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency, the IRS, etc.).

Security of Data

The security of your data is important to us, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

California Online Privacy Protection Act (CalOPPA)

We do not support Do Not Track (“DNT”). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.  You can enable or disable Do Not Track by visiting your web browser's Preferences or Settings page.  In addition to the rights, as explained in this Privacy Policy, California residents who provide Personal Information (as defined in the statute) to obtain products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year, information about the Personal Information we shared, if any, with other businesses for marketing uses. If applicable, this information would include the categories of Personal Information and the names and addresses of those businesses with which we shared such personal information for the immediately prior calendar year (e.g., requests made in the current year will receive information about the prior year).   • The right to correct inaccurate personal information that we maintain about you.

  • The right to delete personal information that we have collected about you, subject to certain exceptions.

  • The right to opt-out of the sale or “sharing” (as that term is defined by the CCPA) of your personal information.  Nytch does not sell or share your personal information and has not done so during the previous 12 months.

  • The right to limit the use of Sensitive Personal Information (SPI), except where the business does not collect or process your SPI for purposes of inferring characteristics about you and limits its use of SPI to that which is necessary to provide the requested services.  We limit our use of SPI to that which is necessary and do not provide you with the ability to further limit your use of your SPI.

  • The right not to receive discriminatory treatment in the event you exercise one of your rights conferred by the CCPA.  In the event you choose to exercise your rights under the CCPA, we will not deny you goods or services, charge you a different price, or provide a different level or quality of goods or services because you exercised your rights under the CCPA.

How we verify your request: you may exercise your rights by submitting a request to do so via the email address referenced above.  Once we receive your request, we will confirm its validity as required under the CCPA.  Depending on the nature of your request, we may seek additional information from you as required by law.  You may use an authorized agent to exercise your rights on your behalf.

Service Providers

We may employ third-party companies and individuals to facilitate our Service (“Service Providers”), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.  These third parties may only have access to some of your basic Personal Data to perform these specific tasks on our behalf and are obligated not to disclose or use it for any other purpose.

We may use third-party Service Providers to monitor and analyze the use of our Service, including, but not limited to

HubSpot is a web analytics service and Customer Relationship management service offered by HubSpot that tracks and reports website traffic. HubSpot uses the data collected to track and monitor the use of our Service. This data is shared with other HubSpot services. HubSpot may use the collected data to contextualize and personalize the ads of its own advertising network.

Behavioral Remarketing

Third-Party Mapping Service Providers

We may use mapping service providers, including, but not limited to, Google Maps, for the purpose of providing better service.

Social Logins   

You may have the ability to choose to register or log in to our services using a social media account, where we may have access to certain information about you.

Our Services offer you the ability to register and login using your third-party social media account details (like your Facebook or LinkedIn logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile Information we receive may vary depending on the social media provider concerned but will often include your name, email address, friends list, profile picture, as well as other information you choose to make public on such social media platforms.

Payments

We may provide paid products and/or services within the Service. In that case, we use third-party services for payment processing (e.g. payment processors). We will not store or collect your payment card details. That information is provided directly to our third-party payment processors, whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. Our Service does not address anyone under the age of 18. We do not knowingly collect personally identifiable information from anyone under the age of 18.
