Nytch Referral Program Terms and Conditions

1. Introduction

1.1. Welcome to the Nytch Referral Program (the "Program"). By participating in the Program, you agree to these Terms and Conditions (the "Terms"). The Program is designed to reward existing customers or partners ("Referrers") for referring new clients ("Referred Businesses") to Nytch.

2. Eligibility

2.1. To participate, Referrers must be existing Nytch customers or retail partners (as defined in the agreement you have in place with Nytch) in good standing.

2.2. Employees of Nytch and their immediate family members are not eligible to participate in the Program.

2.3. The Referred Business must be a new customer to Nytch and cannot have an existing account under any email address or alias.

3. Referral Process

3.1. In order to be a valid referral under the Program, Referrer must complete the online referral form available at https://www.nytch.me/referrals.com.  To be valid and eligible for a payment from Nytch under the Program, Nytch must acknowledge and accept such a referral from Referrer. 

3.2. The Referred Business must acknowledge that the Referrer first informed them of Nytch.

3.3. Within a reasonable time after acceptance of a valid referral, Nytch will remit payment for all accepted referrals through PayPal, and it is the responsibility of the Referrer to be able to accept any such payments through PayPal.  You are solely responsible for your own PayPal account, which includes acceptance of the PayPal terms of use.  Nytch reserves the right to remit payment via a different payment method at its sole and absolute discretion and on a case-by-case basis. 

4. Rewards

4.1. For each Referred Business that successfully signs up and makes a qualifying payment, the Referrer will receive those rewards set forth by Nytch.

4.2. Rewards are subject to change at Nytch's sole and absolute discretion, with or without notice.

5. Limitations

5.1. Referrers may not refer themselves or create multiple accounts to earn rewards.

5.2. Rewards must be claimed within fifteen (15) days of the Referred Business’s qualifying payment.

6. Legal Compliance

6.1. Participants must comply with all applicable laws and regulations, including anti-spam laws. Referral communications should be made in a personal manner.

7. Termination and Changes

7.1. Nytch reserves the right to terminate the Program or change the Terms at any time without notice.

7.2. Nytch may disqualify any participant from the Program at its sole and absolute discretion.

8. LIMITATION OF LIABILITY

8.1. In no event shall Nytch be liable to the Referrer, the Referred Business, or any third party for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (even if Nytch has been advised of the possibility of such damages), arising out of or in connection with the Referral Program or these Terms.

8.2 To the extent permitted by applicable law, Nytch,'s aggregate liability to the Referrer, the Referred Business, or any third party arising out of or in connection with the Referral Program or these Terms shall in no event exceed $100 USD.

9. NO WARRANTY

9.1 The Referral Program is provided "as is" and without any warranty of any kind. Nytch expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the Program, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

10. No Guaranteed Result or Outcome

10.1 The Referrer understands and agrees that Nytch does not guarantee any specific outcomes, results, the success of referrals, or the performance of the Referral Program. Participation in the Program does not guarantee that the Referrer will receive any rewards or that the Referred Businesses will successfully sign up for or purchase Nytch's services.

10.2 The Referrer acknowledges that the success of referrals can be influenced by various factors, including but not limited to the nature of Nytch's services, market conditions, and the individual efforts of the Referrer. As such, there is an inherent risk of non-performance, and Nytch makes no representation regarding the likelihood of success from participating in the Referral Program.

11. Privacy

11.1. Participation in the Program may require the collection and use of personal information. Please refer to Nytch's Privacy Policy.

12. Governing Law

12.1. These Terms are governed by the laws of Delaware.

13. Acknowledgment

13.1. By participating in the Program, you acknowledge that you have read, understood, and agree to these Terms.
